Our Indiana Supreme Court Argument

The All Things Family Law Blog usually publishes articles meant to highlight issues common in Indiana family law, provide notice of online resources, or changes in the law.  This posting is more cathartic and narcissistic.

This posting simply is a link to our Supreme Court argument on a contested adoption case involving the existing Indian Family exception and the Indian Child Welfare Act ("ICWA").  We filed an appeal and took the issue up to the Indiana Supreme Court. We received a 2-3 decision denying transfer.

Getting the case to the Indiana Supreme Court was group effort, which included my entire firm,  Hollingsworth & Zivitz, and especially my co-counsel Abigayle Hensley.  With their support, I was fortunate enough to have the opportunity to argue the case before the Supreme Court, and although the result was not as we hoped (we needed a 3-2 decision, not a 2-3, i.e. one more justice to vote for transfer), it was an awesome opportunity that we won't soon forget.
